Question: I’am currently a stay at home mother and I opened a Roth IRA with Fidelity and did not put my husbands name on it. ( not for any reason just forgot) we file taxes jointly and it’s his income I’m using to invest ( he is aware and supports it) Does his name need to be on the account or can we each have a separate Roth IRA if we wanted to? Your IRA has to be in your own name. It can’t be joint and it can’t be in your spouse’s name. If you are eligible to contribute based on his income (and with his income), then that’s great! It sounds like you did it perfectly. You’ll both have an IRA in each of your individual names. That’s how it legally has to work.
